Emergency Regulations


The Office of Workers' Claims has filed an emergency amendment to regulation, 803 KAR 25:009, Procedure for adjustment of coal workers' pneumoconiosis claims.  This amendment is in response to the ruling by the Kentucky Supreme Court in Hunter Excavating v. Bartrum, 2004-SC-0485-WC.  The amendment allows for an additional x-ray report of one of the original x-rays to be submitted by the parties.  The ordinary regulation has been filed with the emergency.  The ordinary regulation will be published in the administrative register on October 1, 2005.  If a public hearing is requested in writing by October 14, a hearing will be held at the Office of Workers' Claims on October 21, 2005, at 10:00 am (EST).  Please contact Carla Montgomery at 502-564-5550 should you have questions regarding this regulation.
