About Kentucky Occupational Safety and Health Regulations

Kentucky's OSH regulations are adopted under 803 KAR Chapter 2.  These regulations consist of:

  • State-specific regulations unique to Kentucky.
  • OSHA regulations adopted with state-specific provisions.
  • OSHA regulations adopted without change.

Current Regulations

The following industry-specific OSH regulations are enforced in Kentucky:

  • General Industry
  • Construction
  • Maritime
  • Agriculture
  • Injury and Illness Recordkeeping and Reporting

Adoption of OSHA Standards and Policies

The Kentucky Occupational Safety and Health (OSH) Program, under the statutory authority of KRS Chapter 338 and through a state plan approved by the U.S. Department of Labor, OSHA, maintains authority for enforcement, standards promulgation, on-site consultation, and training services related to job safety and health.  Therefore, the Kentucky OSH Program may or may not adopt federal standards or policies. 
 
The first section of the publications entitled "Kentucky Occupational Safety and Health Standards for General Industry" and "Kentucky Occupational Safety and Health Standards for the Construction Industry" identifies regulations that are specific to Kentucky and supersede federal OSH standards. Employers and employees may contact the Kentucky OSH Program at 502-564-3070 to determine if the Kentucky OSH Program comports with federal policies.
